What's going to happen in court?
I got divorced last summer and was awarded child support. 506/ month. The judge also told us we are each responsible for picking up the child (my ex moved 4.5 hours away) from August until last month I was doing the trip 2 sometimes 3 times a month which was costing 200-300 a month while he paid 220 a month in child support. March we went back to court because he was not paying what he should have been. After court my attorney said he thought my ex was lying about why he hadn't been paying (he claims it was my fault for filing through the state for CS before we were divorced). So anyway we go back to court in 2 weeks. I have an attorney, he doesn't. According to the CSA he is behind 3160 to date. This month he again paid only 220 and I lost my job. I went and saw my attorney, explained things and he said to call my ex and tell him he can still have our child every other weekend but he will have to drive both ways unless he is going to make the correct monthly payment. He said to send him a letter stating the same. When I told my ex that he said to go to he'll, that weekend he texted me saying he was on his way. I called the cops and explained things (I didn't have 125 dollars to go get him that weekend) and they called him and reiterated what I had told him. It's the first weekend he had ever missed and he filed a police report against me. He didn't call this weekend which was his. According to the order he had to tell me by May 1 what month he wants our son. So my questions are, when we go to court next how long will they give him to pay the 3000? Can he bring up missing visits? Or does that have to occur at a different kind of hearing (they always say child support and visitation are different)?, will I be found in contempt given the circumstances? And lastly if he doesn't tell me by May 1st what month he wants do I have to allow him the month? Thanks for any advice.
